  1. Introduction
  1. This website is owned and operated by Thrive Wellness Programs (“Thrive”, “we”, “our” “us”), a company focused on facilitating overall health and wellness of individuals.
  2. The use of thrive-wellness.co.za and/or our social networking platforms and related content, and/or participating in a Thrive Wellness Program (“the Service(s)”) are subject to the following terms and conditions (“Terms”).
  3. These Terms are binding and enforceable against every person that accesses or uses our Service (“customer”, “you”, “your” or “user”). By making payment to Thrive and/or by using the Service(s), you acknowledge that you have read and agree to be bound by these Terms.
  4. Please read these Terms carefully – they constitute a fully binding agreement between you and Thrive. Your use of our Service(s) signifies your agreement to these Terms. If you do not agree to these Terms, you are prohibited from using the Service(s).
  5. If there is any provision in these Terms that you do not understand, it is your responsibility to ask a Thrive representative to explain it to you before you continue using the Service(s).

 

  1. Use of the Service(s)
  1. By accessing and/or using the Service(s) you warrant that you are eighteen (18) years of age (or older) and have full legal capacity.
  2. If you are under the age of eighteen (18), or if you lack legal capacity, then you may only access and/or use the Service(s) with consent of your parent or legal guardian. If your parent or legal guardian consents, then such person agrees to be bound to these Terms, and to be liable and responsible for you and all your obligations under these Terms.
  3. By participating in a Thrive Wellness Program you declare that you are in good health and are of sound mind.
  4. The Thrive Wellness Programs and the content published on our website and social networking platforms aim to provide consumers with health and wellness tips and advise, focusing on nutrition, exercise and emotional well-being.
  5. You may use content, information and material provided by us for your personal use only. You may not use the content for any other purpose.
  6. In order to participate in a Thrive Wellness Program, you are required to provide personal information – any personal information processed will be in accordance with applicable laws, and in terms of our Privacy Policy.
  7. Thrive reserves the right, in our sole discretion, to deny participation in a Thrive Wellness Program, as well use of any the Services, to anyone, for any reason whatsoever, as permitted by applicable law.
  8. We reserve the right to change, suspend, or terminate any Service, including any feature or content, at any time for any reason. We may place limitations on the use of certain Services, content or features, and/or limit your access to parts of our Services without notice or liability.

 

  1. Registration and Payment to Participate in a Thrive Wellness Program
  1. The currency used to pay to participate in a Thrive Wellness Program is the South African Rand.
  2. Users may book to participate in a Thrive Wellness Program via our website thrive-wellness.co.za, which Thrive may accept or reject.
  3. Booking on the website does not constitute a confirmed booking – whether or not Thrive accepts a booking via the website depends on receipt of payment, and acceptance of these Terms.
  4. Notwithstanding any communication from Thrive stating that your booking or payment has been confirmed, we will indicate the acceptance of your booking by emailing you the Thrive Wellness Program manual and only at that point will a services agreement between you and Thrive come into effect. In the event a booking needs to be rejected, Thrive will indicate the rejection of your booking by cancelling it and, as soon as possible thereafter, refunding you for any amount paid.
  5. We are committed to ensuring you are able to pay for your booking on our website via a secure, online payment facility. All transactions are encrypted using appropriate encryption technology and payment can be made via:
  6. credit or debit card via PayFast;
  7. electronic funds transfer.
  8. You warrant that you are fully authorised to use the payment method supplied for purposes of paying for your participation in the Thrive Wellness Program. You also warrant that the payment method has sufficient available funds to cover the purchase price.
  9. Should the Customer’s payment provider reject the payment, the booking will not be processed and will be cancelled.
  10. As part of measures taken to prevent fraud, the parties agree that Thrive is entitled to transmit information regarding the order and the Customer’s payment method to a third party for verification purposes.

  1. Recipes / Nutrition Guidance
  1. The Thrive Wellness Programs, including recipes and/or nutritional advice and guidance we provide are not formulated to suit any nutrient deficiencies, allergies or any other food related health problems, and have not been formulated to suit the full nutritional needs of pregnant and breastfeeding women.
  2. If you follow the nutritional advice and guidelines of the Thrive Wellness Programs and/or use any of the recipes we recommend and/or publish, you agree that you do so having sought permission from a medical professional, and at your own risk, particularly if you are pregnant, during post-pregnancy, breastfeeding, suffer from nutrient deficiencies, allergies or any other food related health problems.

 

  1. Workouts / Exercise Training Tips
  1. You acknowledge and agree that by participating in physical activity there exists the possibility of physical injury. If you engage in any of our workouts and/or follow our training tips, you agree that you do so having sought permission from a medical professional, and at your own risk.
  2. If you experience faintness, dizziness, pain or shortness of breath at any time you must stop the physical activity immediately and contact your doctor before resuming.

 

  1. Advice Disclaimer
  1. Thrive provides tips, information, content and services that are intended to assist users in their personal health and wellness efforts. Thrive is not a medical or health services organisation or provider or forum, and we do not engage in patient diagnosis or the practice of medicine.
  2. The content presented by and through the Service(s) is in no way intended as dietry, medical and/or psychiatric advice or therapy. The Service(s) are not and should never be a substitute for the advice of a licensed healthcare provider or medical professional.
  3. You agree that before beginning any dietary or exercise program you have sought advice from a medical doctor, and have been cleared to participate in any such programme (particularly if you have a personal or family history of high blood pressure, heart disease, chest pain, if you are a smoker, have high cholesterol, obesity, bone or joint problems, or if you are pregnant, or during post-pregnancy).

  1. Thrive disclaims all implied warranties, including but not limited to, warranties of compatibility, completeness, accessibility, safety, reliability, security, accuracy or any other aspect.
  1. Although Thrive has taken all reasonable steps to guard against viruses or destructive codes, it gives no warranty that our website and/or social networking platforms are free of viruses or any other data or code that has the ability to corrupt or affect your system.
  2. The use of our Services and/or the website and/or social networking platforms in any form is entirely at the users’ own risk and they are provided ‘as is’, and ‘as available’.
  3. Thrive is not liable for any damages whatsoever relating to your use of the Service(s) in any manner, howsoever arising, including instances of loss caused by the negligence of Thrive and/or its affiliates, partners or representatives.
  4. Unless otherwise noted, the Service(s) and/or content we publish are subject to intellectual property rights that vest in Thrive, or that vest in other entities. You are thus prohibited from using the content from the the Services(s), and/or electronic or written publications, and/or or any other media and/or words, phrases, names, designs or logos without express written permission or unless used in accordance with these Terms.
  5. All information, products and prices available on our website and/or social networking platforms are subject to change without notice.

  1. Limitation of Liability and Indemnity
  1. In addition to clause’s 6 and 7 above, under no circumstances, including, but not limited to, negligence, will Thrive, its affiliates, employees, agents or representatives be liable for any damages (of any kind) that result from the use of, or the inability to use the Service(s).
  2. You agree that you will have no claim against Thrive for any loss, damage or injury suffered as a result of your use of the Service(s) or products connected to our digital and/or social networking platforms.
  3. You agree to indemnify, defend and hold Thrive, its affiliates and/or any of its directors, employees, agents and contractors harmless from and against any and all claims, damages, losses, costs or other expenses that arise directly or indirectly out of or from (i) your breach of these terms; and/or (ii) your activities and/or conduct in connection with the use of our website and/or social networking platforms, and/or your participation in a Thrive Wellness Program.

 

  1. Termination
  1. We reserve the right to cease operating the Service(s) at any time, in our sole discretion, without notice to you, and to terminate this agreement by notifying you of same within a reasonable period of time.

 

  1. General
  1. Thrive may revise these Terms at any time without notice. Although we will endeavor to highlight any changes to these Terms, you should revisit our website periodically to make sure you are aware of the most recent Terms, because they will be binding on you.
  2. In respect of any proceedings arising out of or in connection with this Agreement, the parties agree that this agreement will, for purposes of jurisdiction, have been concluded at our head office at 183 Bree Street, The Cosmetic Science Institute, Cape Town, 8001.
  3. If you have any questions or complaints regarding these Terms or have any queries or comments in relation to the App, please contact us on info@thrive-wellness.co.za and we will endeavor to respond to you promptly.
  4. Each provision of these Terms will be severable from the other provisions. Should any provision be found by a court of competent jurisdiction to be invalid or unenforceable for any reason, the remaining provisions of these Terms will nevertheless remain binding and continue with full force and effect.
